  • Use Classes

    Any Buyer of commercial property needs to be satisfied that the property has the benefit of the appropriate Planning Permission and falls within the correct Use Class of planning legislation. If not, a Planning Application will be required and it would not be safe to exchange contracts unconditionally until the appropriate Planning Permission had been granted.
  • Environmental Issues

    Current legislation can pass onerous responsibilities to the owners of land which may be affected by contamination. The Sellers and Buyers of land which could be so affected need specialist advice as to how these responsibilities are to be addressed.
  • Security of Tenure

    The tenant of premises used for “business” purposes would normally expect to have the benefit of security of tenure, meaning briefly that when the present Lease expires, the tenant would normally be entitled to a fresh Lease on similar terms, apart from the level of rent. It is possible to exclude these security of tenure provisions by agreement between the parties but specialist advice is required as to the consequences, particularly for a tenant.
